VIGO COUNTY, Ind. (WTHI) - An attorney is trying to get something done about the Vigo County Jail issues.
His latest action fell short, for now.
On-going overcrowding problems are at the center of the lawsuit.
Michael Sutherlin is the attorney representing former Vigo County jail inmates in a lawsuit against the county.
He told us that he would file for a three-judge panel in the case.
That panel would have more weight, for example, they would be able to release inmates.
News 10 has learned that a circuit court judge has denied that request.
The judge said he needed Sutherlin to prove two things.
First, that a court has previously entered an order for less extreme solutions that weren't effective.
Second, they to prove Vigo County had enough time to comply with previous court orders.
The judge said Sutherlin could only prove the second of those two points.
The judge said Sutherlin could resubmit for a judging panel again in the future.
News 10 reached out to Sutherlin for a comment, so far, he has not replied.
