VIGO CO., Ind. (WTHI) - Tuesday afternoon, Vigo County Commissioners (VCCs) received this letter from the attorney representing Woodgate homeowners that have homes near the property borderline of Cobblestone Crossings.
In the letter it stated that apartments are being built illegally, and asked the VCCs to put a hold on construction.
Woodgate homeowners were promised single-family homes, zoned R-1; however, they received what they're called illegally-built apartment complexes.
Charlie Williams, President of the Woodgate Homeowners Association said, "Well basically, he's saying the director of area planning exceeded his authority. He told the developer to go ahead and build on property that is still zoned R1, and is building multi-family dwellings."
According to Vigo County's Zoning Ordinance, only the VCCs are allowed to make zoning changes.
A Woodgate homeowner, Mike Poinsett, said the property that's being built behind his home had never received VCCs' zoning approval.
"And in this case, zoning was changed at an area planning meeting, I believe in March of 2007 from R1 to R3 with the stroke of a pen. It did not go back in front of the legislative body," said Poinsett.
According to Poinsett, if the commissioners don't step in and help out the citizens of Vigo County, he and his neighbors plan to take legal action.
Michael Wright, Vigo County Attorney said he will respond to the neighbors' complaint on Thursday.
