Teen not guilty in armed robbery

Incident happened during alleged drug deal

TERRE HAUTE, Ind. (WTHI) - Rocco Cherry's two-day trial wrapped up Thursday.

The nine female, three male jury found Cherry not guilty on seven felony charges, one count of armed robbery and six counts of criminal recklessness.

The incident happened in September 2008 during an alleged drug deal at a Terre Haute home. Following the verdict, the prosecutor said he was disappointed.

Cherry's defense attorney, Christopher Shema, had a message for his client.

"Make better decisions," said Shema. "He put himself in a real bad place. Stupid kid doing stupid stuff."

After the verdict was read, Cherry was not released. He will be held in the Vigo County jail until next week when he will again appear in court facing two other felony charges.
