TERRE HAUTE, Ind. - A decision has been reached in the case between current Terre Haute Mayor Duke Bennett and former mayor Kevin Burke.

Burke first filed the suit after losing his bid for re-election. He claimed Bennett should not have been eligible to become mayor because his former employer, Hamilton Center, receives federal funding. Vigo County Judge David Bolk agreed that Bennett was in violation of the Indiana Mini Hatch Act, but because Bennett was already the Mayor-elect and no longer a candidate, Bolk says the law did not apply. Burke then took the case to the Indiana Court of Appeals, who heard the case in July.
