Burke, Bennett case moves to Ind. court

TERRE HAUTE, Ind. (WTHI) - The Indiana Supreme Court has agreed to hear the case involving Terre Haute's 2007 mayoral race.

Former Terre Haute Mayor Kevin Burke filed suit after the November 2007 election, saying current Mayor Duke Bennett was not eligible to hold the office.

The case has been through several court over the course of a year. Now, the case has been transferred to the Indiana Supreme Court.

In November, the Indiana Court of Appeals ruled Bennett is ineligible for office because he was in violation of the Hatch Act. The court also ruled that neither Bennett nor Burke have a right to the office. Both Bennett and Burke appealed that ruling to the Indiana Supreme Court.
