Gutierrez back in court, child remains hospitalized

TERRE HAUTE, Ind. (WTHI) - A man accused of abusing his ten-month-old baby girl was in court Friday morning.

Police said 20-year-old Fernando Gutierrez held a box of hot rice on the baby's legs. The baby also had several broken bones.

In court Friday, Fernando requested the Mexican consult to be informed of his arrest, since he is not a U.S. citizen.

Fernando faces five charges relating to battery and neglect of a dependent. His jury trial has been set for June 2.

His wife, Dawn Gutierrez who is also facing charges is expected in court Monday.

Police said the baby is still hospitalized at Riley Children's Hospital, her condition is not known.
