Court of Appeals ruling process

TERRE HAUTE, Ind. (WTHI) - With a ruling being made in the Burke-Bennet case, there are still a lot of questions that have not yet been answered.

News 10 spoke with a representative from the Indiana Court of Appeals to find out how judges make tough decisions.

There are three judges that hear each case. Once they have heard the oral arguments from both sides, they begin the ruling process.

"Judges issue a decision just by saying they affirm the case from the lower court or they've reversed it. Our court always writes out a written opinion," Sandhya

Graves from the Indiana Court of Appeals said. Each case decision could take months. Once it is, the written judgement is released to the public.

"Usually, it takes approximately four months, but depending on the case or just on circumstances they can get it done sooner," Graves said.

The three judges do not have to be unanimous in their ruling, but two of the three must be in agreement," Graves said.

Two judges signed off on the opinion. declaring Bennett ineligible. The other judge disagreed and gave a dissenting opinion.
