TERRE HAUTE, Ind. (WTHI) - Vigo County Commissioner David Decker was in federal court Thursday morning for his initial hearing. No date has been set for his hearing on the plea agreement.
Decker is charged with distribution of a substance that has methamphetamine in it, which is a felony. According to court documents, Decker distributed a little more than three grams.
The agreement calls for Decker to serve 10 months in prison and he will have to resign his position as a county commissioner.
The judge did not order Decker to resign on Thursday, but the U.S. Attorney's Office requested that he resign from his position as commissioner.
Decker's attorney William Smock said Decker would resign immediately.
The Vigo County Clerk's office who said they have not received Decker's letter of resignation, but once they receive the letter, it will be sent to the party chairman Joe Etling.
"Then he would set a caucus of all the county democrat committee men within thirty days to fill the vacancy," Vigo County Clerk Pat Mansard said.
