More charges in fatal accident

TERRE HAUTE, Ind. (WTHI) - Additional charges were filed Monday for a man who, police say, is responsible for a fatal car crash. If convicted, he faces up to 20 years in prison.

It happened November 19 at the intersection of Fruitridge and Maple Aves. in Terre Haute.

Ryan Kelly, 25, from Terre Haute died on Thanksgiving Day as a result of that accident, leaving behind his wife of just over a year.

The accident happened when a semi driven by Timothy Clark, 50, of Franklin, Ind., rear-ended Kelly's SUV. Kelly was stopped at a traffic light.

Kelly was flown to Indianapolis with severe head injuries, where he later died.

Clark admitted to smoking crack cocaine the night before and said he fell asleep several times while driving that morning.

"Today we filed six, a total of six charges, which takes into account that the victim had actually passed away as a result," Vigo Co. Prosecutor Terry Modesitt said.

The charges include reckless homicide and causing death when operating a motor vehicle with a blood alcohol content of .08 or more while license suspended or revoked.

According to police reports, Clark has three previous OWI convictions, the most recent from June 2010.

Clark's bond remains at $25,000 cash only.

His trial date is set for May 24.
