TERRE HAUTE, Ind. (WTHI) - A federal civil lawsuit was filed against the Vigo County Council.

The suit was filed on behalf of a local resident saying the commissioners failed to follow the law when redistricting after the 2010 Census.

The allegation is that the new council districts are not equal in size.

The lawsuit is filed through the American Civil Liberties Union.

The current districts vary in size, with differences of as much as 33 percent.

"The Constitution guarantees that all of our votes should be equal...therefore, if you have a situation where the population in districts are not close to each other, you have unequal votes and that violates the Constitution," American Civil Liberties Union Director Ken Falk said.

Vigo County commissioners were unable to comment.
