DUGGER, Ind. (WTHI) - A man related to Sunday morning’s shooting in Dugger, Indiana is released from police custody and becomes a victim in the case.

The weekend shooting sent three people to the hospital and lands one of them in jail.

It all happened early Sunday morning in Sullivan County Indiana.

On Monday afternoon, one suspect appeared in court in police custody, but by the time he left the courthouse, he was no longer a suspect but a victim.

According to police, a man, Patrick Ruff, and a woman, LeighAnn Lovelace, were both shot in the head outside a tavern in Dugger.

The shooter, Timothy Kean and the two victims all know each other, but police can't confirm exactly how.

Police say after the first shooting, Kean then shot at a passing car driven by James Gardner.

Gardner followed Kean to a house in rural Dugger, which is where police say Kean was battered.

Kean is in police custody tonight, but James Gardner has been released.

The prosecutor calls Gardner a victim in the alleged crime, and he tells News 10 he expects to file three charges of attempted murder against Timothy Kean.

He's expected in court on Tuesday.

News 10 also confirmed with the Sullivan County Sheriff's Department of an attempted suicide at the jail.

That individual is in critical condition at Methodist Hospital in Indianapolis.

The sheriff's department is not saying whether or not the two situations are related.

Lovelace is expected to recover from her gunshot wounds; however, Patrick Ruff remains in critical condition.
